Guarantee and Limitation of Liability

While much testing is done on a variety of sites and with a variety of data, there is no guarantee that any plugin will work seamlessly on your specific installation. You are responsible for testing the integration.

While support and assistance and advice is often provided, there is no guarantee of support and certainly no guarantee of response within any given time frame. You should allow adequate time to research and test plugins for your needs prior to your deadlines.

In no event shall the plugin provider be liable to you or any party related to you for any indirect, incidental, consequential, special, exemplary, or punitive damages or lost profits. In any event, the total aggregate liability to you for all damages of every kind and type (regardless of whether based in contract or tort) shall not exceed the purchase price of the product.

Licensing for updates

A valid and active license key is required in order to get updates and support for purchased extensions and themes. Most licenses are valid for one year from the date of purchase. After one year, license keys can usually be renewed at a discount from the purchase price of a new license.

Software updates

Updates are included for free for othe license period. If you have a valid and active license key, and your extension(s) supports it, updates will be delivered automatically from the WordPress dashboard. If your extension(s) does not support automatic upgrades, then updates can be downloaded from your account page.

Support

Support for purchased extensions is available for the license period or for any additional purchased support periods. If you wish to get support after the initial expiry, you must renew your license key, purchase Priority Support access, or purchase a new license for the extension you wish to get support for. While we try to provide timely support, there is no guarantee of response.

There may also be time periods where support is simply not available for any of a number of reasons from holidays, health, power or internet outages and /or natural disasters. Support is generally limited to direct problems and may exclude consulting, general css or integrations with other themes or plugins. A certain level of html, css, use of phpmyadmin and ftp knowledge is assumed from anyone managing a website. If your knowledge level requires a greater degree of assistance and service, an additional charge may apply.

Testing and Reverting

You are responsible for keeping copies of earlier versions and backing up your site prior to plugin installation. You should test all plugins on a non-live system before installing. You should know how to remove a plugin should it not work well with your custom setup.

Trial Versions

Because of the nature of php code, it is not possible to offer ‘trial’ versions. Once you have the plugin you have it, there is no way to ‘expire’ it.  Therefore the following are provided to help you assess the plugins before purchasing access:

Refund Policy

Please see the section above on trial versions, and do your research before purchasing.   Php based plugins and themes are digitally delivered, and are non-tangible goods that cannot be expired or deactivated or returned.

Thus in line  with other providers, refunds or chargebacks  will not be offered except under exceptional circumstances, and in particular not after 30 days.

If you are experiencing problems, please post a support topic.  These are usually resolved fairly promptly.

Specifically there is no obligation to provide a refund or credit where:

  • you have changed your mind about an item;
  • you bought an item by mistake (unless you have not downloaded the item);
  • you do not have sufficient expertise to use the item;
  • you ask for goodwill; or
  • you can no longer access the item because it has been removed – please download items as soon as you buy them.

In the unlikely event that a refund or credit is issued, an administration charge may be deducted.  Any refund will be done using the same manner used to make the purchase.

Ethical behaviour, paypal chargebacks

In the many years that these plugins have been available, there have been  a couple of people who have outright lied in order to get plugins for free.  In one example a ‘professional’ person offered to be a tester, did nothing and admitted later they’d lied just to get the plugins for free.     Another person launched a paypal dispute with no prior communication simply because they changed their mind and naively thought that would be a good way to deal with it.   The paypal api sends a ‘hold’ and the account is frozen this end while paypal evaluates – they like to see some communication about what is it “that is not as described” and some attempt at resolution.   Once paypal sees that it’s for digital goods that were downloaded and that  work as described (see demo system).      Please don’t be one of those…
